Justice Dept. Cites Race in Halting Law Over Voter ID

In a letter to the South Carolina government, Thomas E. Perez, the assistant attorney for civil rights, said that allowing the new requirement to go into effect would have “significant racial disparities.”
Richard L. Hasen, an election law specialist at the University of California, Irvine, predicted on his Election Law Blog that the state would go to court, which could set up a “momentous” decision in the Supreme Court on whether a part of the Voting Rights Act that prevents states like South Carolina from changing their voting rules without federal permission is unconstitutional.
Gov. Nikki Haley denounced the decision, accusing the Obama administration of “bullying” the state.
Complicating matters, this week the Department of Motor Vehicles called into question the data the state had provided. It said that although the report said 240,000 registered voters lacked a state-issued identification card, the real figure was probably closer to 80,000 because many had died or moved away.
In its letter, the Justice Department said that the new data — which contained no demographic breakdown — did not change its decision because the burden is on the state to prove that its change to election rules would not suppress minority voting. But it also noted that the state could ask the department to reconsider its decision on the basis of new information, once it re-examines the demographics.
Restrictions on voting and vote fraud have been an increasingly contentious topic of partisan dispute. Supporters — mostly Republicans — have portrayed voting fraud as rampant, and say restrictions are necessary to prevent the dilution of ballots cast by legitimate voters. Critics — mostly Democrats — contend that the restrictions are a veiled effort to suppress participation by legitimate voters who tend to favor their party’s candidates.
Documented cases of the sort of fraud that photo identification laws seek to limit — ineligible people showing up at the polls and casting ballots in person — have been few and isolated, although there is greater evidence that absentee ballot fraud has been used to attempt to alter the results of an election, including a 1997 mayoral election in Miami.
South Carolina’s current rules, enacted in 1988, allow people to vote by presenting a voter registration card and signing a document. The Justice Department letter said that while the state had justified adding the requirement to present photographic identification as a way to deter fraud, it did not submit “any evidence or instance” of “in-person voter impersonation” or some other kind of fraud that could be deterred by the new requirement.
The jostling ahead of the 2012 election cycle comes against the backdrop of the 2008 election, when a huge turnout of young and minority voters helped propel Mr. Obama to victory. In 2010, voting by such groups dropped as enthusiasm among more conservative factions surged, and Republicans won sweeping victories — including winning or expanding control of many state legislatures and governorships.

Education Project in Los Angeles, said Saturday. "We're mobilizing voters. That's the big deal." But
immigration control advocates say the marches last spring doomed activists'
efforts by alienating most Americans and strengthening support for stronger
border control and opposition to legalization."The mass sea of illegal aliens bearing foreign flags and hostile
placards really produced a pronounced backlash, from which they've never
recovered," said John Keeley, spokesman for the Washington-based Center
for Immigration Studies.The movement's fate is in question just months
after hundreds of thousands of immigrants and their supporters startled the
nation by pouring into the streets to protest a House bill that would
criminalize undocumented immigrants and those who support them. Buoyed by their
success, they helped push the U.S. Senate to pass a landmark bill increasing
visas and offering legalization to many of the nation's estimated 11 million
undocumented immigrants. Since then, some activists acknowledge, their ranks
have become demoralized as congressional action on the issue stalled over the
summer and recent marches have fallen flat. In Los Angeles, for instance, police
estimated that only about 1,500 people turned out for a Labor Day weekend rally
that organizers had predicted would draw as many as 50,000. And Cecilia Munoz, a vice president of the
National Council of La Raza, said some immigrants were reluctant to risk their
jobs to march because the likelihood of legalization and other reform does not
appear imminent."A lot of people feel a loss," immigrant activist
Oscar Garcon said Saturday at the National Latino Congreso, which was billed as
the most comprehensive gathering of Latino leaders in nearly 30 years.
"They say, 'We demonstrated, we came out by the millions, but what did we
change?' "But he and others said a movement cannot fairly be measured by
the size of its marches or its early setbacks, and some experts agree. Louis
DeSipio, a UC Irvine associate professor of political science and
Chicano/Latino studies, said it was premature to dismiss prospects for broad
immigration reform. He said such aims could take years to achieve. The 1986
amnesty for illegal immigrants, for instance, took a decade to pass and did so
abruptly, just as most members of Congress thought the provision dead. DeSipio
said movements cannot be built from marches alone."It's good they've moved
away from the marches," he said. "Marches can get people's attention,
but it doesn't necessarily get a higher percentage of the community involved in
civic participation. That's what things
like get-out-the-vote and voter registration drives do."DeSipio said
the ferment over immigration could in time lead to a surge in Latino voters
similar to the one after the 1994 passage of Proposition 187. The measure would
have denied health benefits to undocumented immigrants had it not been
overturned in the courts. The number of legal residents who became U.S. citizens
increased from 434,000 in 1994 to more than 1 million in 1996; and Latino
registered voters in California increased from 1.6 million in 1996 to 1.9
million in 2000, according to the National Assn. of Latino Elected and
Appointed Officials Educational Fund in Los Angeles. Activists argue that some
preliminary data offer evidence of another surge. According to U.S. immigration
statistics, the number of citizenship applications increased by 41.5% in May
over last year, a far larger increase than in previous periods."This is
one of many issues, and it's going to take time, but it will come," said
Cristina Basurto, 32, a member of Women of Earth, a social justice
organization, who attended a small rally after the conference Saturday near
downtown. "I think people still have it in their hearts and still want to
fight for what they believe in."The number of new Latino voters grew by
35,000 in Los Angeles County from March to August, helping to boost their share
of the electorate from 20% to 24% over last year, according to an analysis of
Los Angeles County registrar-recorder data by the Latino officials'
organization. Marcelo Gaete, the organization's senior program director, said
his staff used a surname dictionary to determine how many of the county's new
voters were Latino. Keeley, however, said the political landscape proves his
point: A get-tough stand on immigration is a winning political message. In Pennsylvania, for instance, he said
Republican Sen. Rick Santorum is rapidly closing what had been a double-digit
deficit in the polls in his race against his Democratic challenger, state
Treasurer Robert Casey Jr., by campaigning with a tough immigration message.
He also said congressional hearings on immigration and local town halls during
the summer recess have convinced many legislators that constituents see border
control as a top priority. As a result, he said, "the chances are less
than zero" of winning legalization this year. Some Latino activists,
including UC Riverside ethnic studies department Chairman Armando Navarro,
agree that the movement for immigrant rights has lost steam. He said internal
squabbling, a lack of leadership and a failure to organize immigrants for
long-term political change had squandered their gains of the spring. DeSipio
and others, however, said activists had already scored a significant victory by
so far stopping the House bill, especially the provision that would criminalize
undocumented immigrants and those who aid them, from becoming law. Elements of
that bill, including border enforcement measures, however, may still pass. Now,
activists say, they are gearing up to launch what they envision will be a
long-term effort to mobilize Latino voters for elections this November and,
more important, in 2008.Two organizations — the Service Employees International
Union and the Southwest Voter Registration Education Project — have raised $7
million for national voter registration and get-out-the-vote efforts. The
National Assn. of Latino Elected and Appointed Officials plans to include
150,000 voter registration cards in La Opinion later this month and help
sponsor another major workshop at the L.A. Convention Center to help immigrants
apply for citizenship. A July workshop produced about 1,300 completed new
citizenship applications, Gaete said.Spanish-language radio DJs, who helped
turn masses out for marches, have also begun to actively promote voter

Justice Dept. Cites Race in Halting Law Over Voter ID

WASHINGTON — The
Justice Department on Friday blocked a new South Carolina law that would
require voters to present photo identification, saying the law would
disproportionately suppress turnout among eligible minority voters.
The move was the
first time since 1994 that the department has exercised its powers under the Voting Rights Act to
block a voter identification law. It followed a speech
this month by Attorney General Eric H. Holder Jr. that signaled an aggressive
stance in reviewing a wave of new state voting restrictions, largely enacted by
Republicans in the name of fighting fraud. In a letter to the South Carolina government, Thomas E. Perez, the assistant attorney for civil rights, said that allowing the new requirement to go into effect would have “significant racial disparities.”
He cited data
supplied by the state as showing that there were “81,938 minority citizens who
are already registered to vote and who lack” such identification, and that
these voters are nearly 20 percent more likely be “disenfranchised” by the
change than white voters.
South Carolina
now faces the choice of dropping the proposed change or asking a federal court
in the District of Columbia to approve the law. Richard L. Hasen, an election law specialist at the University of California, Irvine, predicted on his Election Law Blog that the state would go to court, which could set up a “momentous” decision in the Supreme Court on whether a part of the Voting Rights Act that prevents states like South Carolina from changing their voting rules without federal permission is unconstitutional.

outrageous, and we plan to look at every possible option to get this terrible,
clearly political decision overturned so we can protect the integrity of our
electoral process and our 10th Amendment rights,” she said in a statement.
Under the Voting
Rights Act, an election rule or practice that disproportionately affects
minority voters is illegal — even if there is no sign of discriminatory intent.
South Carolina is one of several states that, because of a history of
discriminatory practices, must prove that a measure would not
disproportionately discourage minority voting.
Such states must
receive “pre-clearance” from the Justice Department or a federal court before
any proposed change to elections rules can take place. South Carolina provided
data comparing its registered voters to those who had an identification card
issued by the Department of Motor Vehicles, including a demographic breakdown

is taking fire from Democratic legislators and others who say she has
overstated her case on illegal voting and object to her use of state police in
the matter.

Duran, New Mexico's secretary of State who took office in January, sounded a
tad pugnacious in March when she reported that 117 foreign nationals with phony
Social Security numbers had registered to vote and 37 had cast ballots in
elections.
There was, she said, "a culture of corruption" in the state.
Duran, who had ordered her staff to check 1.16 million voter registration records against motor vehicle and Social Security databases, also raised eyebrows by referring 64,000 voter registration records to the state police, citing irregularities.
No one has been charged with a crime, and Duran, a former Republican state senator and county clerk, has since taken fire from Democratic legislators, public interest groups and news organizations that say she has overstated her case, scared voters and withheld proof of her claims.
Duran maintains that she is just doing what she was elected to do. "I am simply adhering to the promise I made to voters all over the state," she said in an interview.
"My concern is she is creating fear and causing people not to go to the polls and suppressing the vote," said state Sen. Peter Wirth, a Santa Fe Democrat and co-chairman of the legislative Courts, Corrections and Justice Committee, whose members grilled Duran during a public hearing July 15.
"She wants to clean up the voter rolls — that's a good thing," Wirth said. "But using the state police creates a perception of wrongdoing."
Duran's disclosures prompted reporters and the American Civil Liberties Union of New Mexico to file open-records requests for details of her investigation. Duran eventually released heavily redacted documents, citing executive privilege for withholding most of the information.
The ACLU sued Duran on July 20 to release more information.
"The major issue is transparency," said ACLU managing attorney Laura Schauer Ives. "Without it, elected officials are able to act in a shroud of secrecy."
The Albuquerque Journal, which had endorsed Duran's candidacy, accused her of hypocrisy in an editorial: "To gauge her progress so far, all they can do is read between her pages and pages of redacted lines."
Duran's move to scrub the voter rolls reflects a national GOP preoccupation with preventing illegal voting, said Denise Lamb, a former state elections director and a registered independent.
"All over the country there is a movement by predominantly the Republican Party to get voter ID laws passed," she said. "On their side, they say it's about fraud — election fraud at the polls is virtually undetectable and you have to do this."
But Democrats contend that requiring a driver's license at polling places tends to discourage voting by seniors who have given up driving, students, minorities and the homeless, Lamb said.
Lamb doubts illegal voting is widespread, calling it "a low-yield felony." She recalled a single documented example of a noncitizen voting during her 10-year tenure with the elections bureau. It involved a Russian scientist at Los Alamos National Laboratory who was about to become a naturalized U.S. citizen and had mistakenly voted in a school election.
Duran denies discouraging anyone from voting and says her comments have been misconstrued. As the first New Mexico secretary of State to cross-check the databases, she was merely following the example of 42 other states, she said.
Duran acknowledged that the "vast majority" of irregularities found in the database cross-checks had probably resulted from routine errors made by county clerks while entering information from handwritten voter registration cards into the computer system.
In New Mexico, one of two states that permit undocumented residents to obtain driver's licenses, clerks routinely offer voter registration forms to patrons at motor vehicles offices in compliance with federal motor-voter laws, Duran said.
It's possible that some who are ineligible to vote may have inadvertently filled out the registration forms with the other paperwork. "It may not even have been their intention to register when they should not have," she said. "I have never asserted there have been huge numbers of people attempting to vote."
Duran declined, on her lawyer's advice, to discuss the ACLU lawsuit or her broad claim of executive privilege in withholding records, but said she was confident the controversy had not damaged her credibility.
Lamb, who has known Duran for years, called her "basically a very decent public official," adding, "I think it was inartful communication."
