1. Dianne Feinstein takes money hand over fist from WELLS FARGO ( Opensecrets.org). She was their front whore for the BIG BANKER’S BANKRUPTCY BILL that became law and prevented people victimized by dishonest sub-prime mortgage products to obtain help in Court.
The so called “foreclosure” aid bill now before Congress has will not fix this. Big Bankers said HELL NO! WE PILLAGE FOR PROFIT!

2. At the time whore Dianne Feinstein fronted for the bankruptcy bill, WELLS FARGO had already had their CALIFORNIA MORTGAGE LICENSE REVOKED. The bank continues to operate WITHOUT a license. The revocation was due to corporate fraud and maleficence with their mortgage products.

3. WELLS FARGO continued operating their dishonest mortgage products all over the country. There are many municipalities that have filed lawsuits against this bank as a result. WELLS FARGO particularly gears its marketing to non-English speaking illegals and minorities. They’re easier prey.

Currently the Cities of Cleveland and Baltimore have filed lawsuits against WELLS FARGO for the devastation their mortgage products have caused.

4. WELLS FARGO illegally opens bank accounts for illegals using the phoney Mexican consulate ID’s. In other words NO ID! Of the billions from the American economy that WELLS FARGO wires back to Mexico, about 20% is Mexican drug cartel money.

5. WELLS FARGO and BANK OF AMERICA are major La Raza party donors. La Raza... “The Race” is the Mexican supremacist racist party advocating no laws or borders apply to Mexicans invading. Dianne Feinstein is an OPEN BORDERS advocate while sending the same letter to her legal constituients suggesting she’s “concerned” about the Mexcian invasion. 7. WELLS FARGO does not hire American born employees. They are all H-1 visas. Primarily Chinese, Indians and middle-easterners. The Big Banks had too many Americas file Class Action suits against them and now only want “temporary” employees that will keep their mouths shut about the miserable conditions they work under.


8. The profit margin of WELLS FARGO and BANK of AMERICA bank cards is so massive even the oil industry salivates. Any attempt to reduce the outrageous terms which the banks may unilaterally change at a whim were destroyed with the FEINSTEIN BIG BANKER’S BANKRUPTCY law.

Wells Fargo & Co., the top U.S. home lender, and Morgan Stanley, owner of the world's largest brokerage, led financial stocks higher after reporting second-quarter earnings that beat analysts' estimates.
Wells Fargo, whose net income of 55 cents per diluted share surpassed estimates of 49 cents, gained as much as 6.5 percent. Morgan Stanley, which said revenue from trading stocks surpassed all five of its bigger competitors, rose as much as 10.6 percent, the biggest gain in more than a year.
"The economy is doing modestly better, and the credit issues aren't getting worse," said Malcolm Polley, who oversees $1 billion as chief investment officer at Stewart Capital Advisors in Indiana, Pa.
Wednesday's results from San Francisco's Wells Fargo and Morgan Stanley, headquartered in New York, were at odds with banks that reported in the past week. Goldman Sachs Group Inc.'s earnings on Tuesday missed analysts' estimates as trading revenue fell 36 percent from the first quarter. Bank of America Corp. and Citigroup each plunged more than 6 percent Friday after saying profit fell from a year earlier.
Wells Fargo said net income declined 3 percent to $3.06 billion (55 cents per share), from $3.17 billion (57 cents) in the same period a year earlier. The average estimate of 25 analysts surveyed by Bloomberg was 49 cents, adjusted for one-time items.
"Credit quality has indeed turned the corner," Chief Financial Officer Howard Atkins said in a statement. "We expect this positive trend will continue over the coming year."
Analysts and investors are looking at the largest U.S. banks for confirmation that credit losses are shrinking. Bank of America, the biggest U.S. lender, told investors last week that credit quality is improving, and June credit-card write-offs fell at five of the six largest card issuers.
Wells Fargo has said consumer loan losses peaked in the first half, and commercial loan losses will crest in the second half. The bank's largest stakeholder is Berkshire Hathaway Inc., the insurance and industrial company controlled by billionaire Warren Buffett.
Chief Executive Officer John Stumpf is increasing fee revenue as the bank works to cut expenses and counter sluggish consumer and business lending. Some parts of the financial overhaul passed by Congress may have "unintended negative consequences," he said in the statement.
At Morgan Stanley, net income rose to $1.96 billion ($1.09 per share) from $149 million, a loss of $1.10 per share, in the second quarter of 2009. Earnings from continuing operations were 80 cents per share, which included a 20-cent tax benefit, compared with the 47-cent average estimate of 21 analysts surveyed by Bloomberg.
Chief Executive Officer James Gorman has added employees to Morgan Stanley's sales and trading unit to close a gap with competitors. Stock-trading revenue surged 82 percent from a year earlier, and the 12 percent decline in overall trading revenue from the first quarter was smaller than the drop at bigger banks.
"Quite impressive compared to Goldman Sachs," said Gary Townsend, chief executive officer of Hill-Townsend Capital LLC in Chevy Chase, Md., which owns Morgan Stanley shares. "Morgan has just not had as pronounced a view as Goldman has had, it has generally been taking less risk over the past several quarters, and that helped it here."

States Can Investigate National Banks, Justices Rule

The Supreme Court paved the way on Monday for states to enforce fair-lending laws and other consumer protection measures against the nation’s biggest banks, striking down a rule that limited such powers to federal banking regulators.
The court concluded that rules issued by federal banking regulators under the National Bank Act — a law passed in 1864 — could not block, or pre-empt, efforts by the states to enforce their laws.
The case began with letters sent in 2005 by the New York attorney general at the time, Eliot Spitzer, to several national banks, including Citigroup, JPMorgan Chase and Wells Fargo, inquiring about their lending practices to minority customers.
The letters referred to “troubling” disparities that suggested black and Hispanic borrowers were charged disproportionately higher interest rates on mortgages compared with those for whites.
The letters asked for the information “in lieu of subpoena” but strongly suggested that subpoenas might follow if the requests were not fulfilled. A banking trade group and the Office of the Comptroller of the Currency brought suit to block Mr. Spitzer’s request, contending that the National Bank Act and rules issued by the Bush administration in 2004 gave that kind of law enforcement authority to the comptroller and prohibited such efforts by the states. A federal district court ruled against the states, and the United States Court of Appeals for the Second Circuit affirmed the lower court’s decision.
Writing for a 5-to-4 majority, Justice Antonin Scalia concluded that the attorney general had not been engaged in the broad “visitorial powers” reserved by the federal government, in which the government acts like a supervisor with free access to bank records on demand. The court, he wrote, has always understood that visitorial powers are “quite separate” from the power to enforce the law, and Mr. Cuomo was acting in the role of “sovereign-as-law-enforcer” in seeking the information.
Normally, Justice Scalia wrote, the court would defer to an agency’s interpretation of the law when the terms in dispute are ambiguous. But in this case, which turned on such terms as “visitorial powers,” he stated that even though the term was “somewhat ambiguous,” the court could discern “the outer limits” of the term, “even through the clouded lens of history.” The meaning that could be wrestled from the phrase, Justice Scalia wrote, did not include restrictions on “ordinary enforcement of the law” by the states.
The decision brought together an unusual coalition of jurists. Justice Scalia, one of the court’s most conservative members, was joined by the court’s more liberal wing of John Paul Stevens, David H. Souter, Ruth Bader Ginsburg and Stephen G. Breyer.
A decision concurring in part and dissenting in part was written by Justice Clarence Thomas and was joined by Chief Justice John G. Roberts Jr. and Justices Anthony M. Kennedy and Samuel A. Alito, Jr., who did not share Justice Scalia’s view through the clouded lens of history. “The statutory term ‘visitorial powers’ is susceptible to more than one meaning,” Justice Thomas wrote, “and the agency’s construction is reasonable” and thus should be deferred to.
In a statement, New York’s current attorney general, Andrew M. Cuomo, called the decision “a huge win for consumers across the nation.” In a reference to the nation’s economic crisis, Mr. Cuomo added, “the court has recognized that fair lending and consumer protection — the cornerstones of a sound economy — require the cooperative efforts of both the states and the federal government.”
Seth Galanter, a lawyer in Washington who wrote a brief on behalf of former comptrollers, said that the worst case envisioned by federal regulators had not come to pass. While the decision does not block the attorneys general from enforcing state laws, he noted, it does require judicial approval to gain access to records. “Our concern was really the establishment of 50 state supervisory regimes, where states could come in and look at the books whenever they wanted to,” he said.
The federal regulators had argued that their informal approach worked quietly with banks to address issues like fair lending in a “prophylactic way” that protected consumers.
John Cooney, a lawyer in Washington who specializes in bank regulation and a former assistant solicitor general, said that the decision upholds the theme of federalism that has run through several important cases of this just-ended Supreme Court term, but added that the banking decision would now require action by the legislative branch. “People are going to go to Congress and say, ‘You need to give us a functioning principle’ to define the boundaries of state and federal law,” he said. “The ultimate court of appeal will be Congress.”
James E. Tierney, director of the national state attorneys general program at Columbia University law school, said that a line-drawing exercise by Congress was unlikely to put state enforcers on the sidelines again. In the absence of tough regulation of the banking industry by the federal government, he said, state attorneys general have stepped up to provide consumer protection and to fight discrimination. He called the case “a stinging defeat for the large banks and federal regulators who have worked for years to stop states from enforcing state consumer protection and anti-discrimination laws.”
Senator Patrick Leahy, Democrat of Vermont, agreed, calling the decision “a check against the former Bush administration’s attempt to prohibit state law from protecting consumers.”

State sues Wells for $1.5 billion

(04-23) 13:58 PDT San Francisco -- Attorney General Jerry Brown filed a securities fraud lawsuit against Wells Fargo & Co. on Thursday, accusing the San Francisco bank of deceptively marketing a type of financial instrument and seeking to recover around $1.5 billion for thousands of California investors.
The Superior Court suit claims that three affiliates of the company falsely proclaimed so called auction-rate securities "as safe and liquid as cash," even though about 2,400state residents who invested in the financial instruments have been unable to recover their money for more than year.
An ARS is a long-term debt tool that in normal times functions like a short-term one, because it trades regularly through auctions. Until recently, people could get their money out in a matter of days and earned slightly higher returns than on a savings account. But the auction market collapsed in February 2008 as the economy weakened and credit markets tightened, freezing up the assets.
"More than 2,000 California investors who thought they could get their money back when they needed it, now can't," Brown said at a press conference in San Francisco. "What we're seeing today is another example of the complicated financial transactions, the so-called financial products, that have been part of this massive financial bubble that burst and caused so much suffering and continues to cause so much havoc in individual people's lives."
Wells Fargo, which announced record quarterly profits of $3.05 billion on Wednesday, disputed the allegations.
"We fully understand and deeply regret the effects this prolonged liquidity crisis has had on our clients," said Charles Daggs, chief executive officer of Wells Fargo Investments LLC, in a prepared statement. "Wells Fargo could not have predicted these extraordinary circumstances, and even with the benefit of hindsight is not responsible for them."
Brown said an economic downturn is a foreseeable event that doesn't excuse marketing the product as safe and highly liquid in the first place.
"It's misleading, it's a fraud and it violates the securities laws of California," he said.
The Wells Fargo statement didn't address the promotion of the products, the core issue in the complaint, and the company didn't immediately respond to a follow-up inquiry.
Across the country, nearly 5,700 investors purchased $2.9 billion worth of auction-rate securities from the Wells affiliates, according to Brown's office. Several major banks, including UBS and Merrill Lynch, compensated their customers for the securities in the months following the market lock up.
Senior Assistant Attorney General Mark Breckler, who met with Wells Fargo, said of the bank: "To date, they've taken the steadfast position that they're not liable." He declined to otherwise discuss the talks.
In addition to the cash value of the securities, the suit seeks the relinquishing of any profits tied to them and civil penalties potentially totaling hundreds of millions of dollars.

Obama soft on illegals enforcement

Arrests of illegal immigrant workers have dropped precipitously under President Obama, according to figures released Wednesday. Criminal arrests, administrative arrests, indictments and convictions of illegal immigrants at work sites all fell by more than 50 percent from fiscal 2008 to fiscal 2009.

The figures show that Mr. Obama has made good on his pledge to shift enforcement away from going after illegal immigrant workers themselves - but at the expense of Americans' jobs, said Rep. Lamar Smith of Texas, the Republican who compiled the numbers from the Department of Homeland Security's U.S. Immigration and Customs Enforcement agency (ICE). Mr. Smith, the top Republican on the House Judiciary Committee, said a period of economic turmoil is the wrong time to be cutting enforcement and letting illegal immigrants take jobs that Americans otherwise would hold.

Harlan, Kentucky resident speaks to the WSWS

Henrietta Inman, 64, spoke to World Socialist Web Site reporters at the Housing Authority of Harlan, a Housing and Urban Development-subsidized apartment building in downtown Harlan, Kentucky. The apartment building was among the largest buildings in town, and full of hundreds of elderly residents and families.

“Harlan used to be a thriving town,” Henrietta said. “There weren’t as many people, but there was work. All the work that is here for the young people today is low wage. Prices of everything are so high you can’t afford anything.”

Henrietta lives on a Social Security check of $600 a month. Her rent, $198 a month, is figured by the federal Housing and Urban Development (HUD) based on her income, and set at just under 30 percent of her monthly allotment—technically under the government’s “housing burdened” threshold for the proportion of income used to pay rent.

“It’s a roof over your head. That’s about all,” she said of the apartment complex. “It was the cheapest place I could find. But it’s not like renting a house or a trailer, where you can have flowers and stuff, it’s not like that. There are six floors and all of them are full. We’re not allowed to have any animals; there is no place to garden, and nothing to do in town now. We sit here and do puzzles,” she said, gesturing to a table full of puzzle pieces and boxes. Several other residents present during the interview nodded in agreement.

Henrietta’s husband was a coal miner working in a union mine in the 1970s and 1980s. Harlan County had been home to some of the most intense and violent labor struggles in the United States during the first half of the 20th Century, earning the county the nickname “Bloody Harlan.”

In the 1970s, workers seeking to unionize their mines were once again met with violence from the hired thugs of the coal operators. In 1973, miners at the Eastover Coal Company’s Brookside Mine and Prep Plant went on strike for union recognition. After a bitter 13-month struggle, during which time a young miner named Lawrence Jones was murdered by company thugs and workers were forced to arm themselves on the picket lines, the miners won a contract.

In the following decades, the betrayals of the United Mine Workers of America and the deregulation of the coal industry facilitated an assault on the living standards of Harlan workers, and the gains won by miners in earlier decades came under attack. Today there are no union mines in Harlan.

“Life was very hard in the 1970s,” she said. At the time of the Brookside strike, “I had four children then, and it was hard. One of my daughters was born in 1970. But I feel it’s a whole lot worse now. There’s no work—just the fast food restaurants. We need factories and industry in here to where the young people coming up will have somewhere to work.

“Our roads are in bad condition,” she added. “They patch them up here and there but we need a lot more done.

“Younger people have nothing to do. There are a lot of drug problems here because of that. I worry about the youth. We need something for 12-year-olds and 14-year-olds who are coming up here, because they’re not going to have anything either. It’s not just Harlan. It’s everywhere. Indiana used to be a booming place, too—my dad lived there. It’s gone downhill, too. It’s just really sad. Harlan used to be a beautiful place. I don’t know whether it’s the people they put in office, whatever they vote for in there, or what. I don’t think they represent us.”

Henrietta expressed deep concern over the ruthless energy costs imposed by Kentucky Utilities on the poor. Most of the coal bound for KU power plants is extracted from Harlan and surrounding counties. KU and other utility companies in the state are pursuing double-digit rate increases this year. “These high gas prices and oil prices and the electricity—it’s gotten outrageous,” she said. “Poor people have to have their electricity to cook and stuff like that, and the prices are supposed to go up again. It’s really unfair, because they barely make enough to live on, and these big bills are coming at them. Big electric bills, especially in the winter, are impossible.”

Another resident interjected, “What you think about when people’s light bills are $600 a month and they live on a small, low income? What do you think about that?”

Henrietta explained, “When they can’t pay their electric bills, they get cut off. One guy had three children. And he didn’t have money to pay it, and they cut his electric off in the winter.” The advocacy group Community Action, she told the WSWS, “is sent hundreds of thousands of dollars to help poor people, but I don’t know if that money is being used right or not. There are lot of people that, later on in the year when it’s chilly, can’t go over there and get their electric bill paid. Community Action is paid to do a good job on people’s homes to winterize them—but they get the cheapest windows that can be bought, and those windows are not going to hold the cold out. You can just feel the air coming through them. One little old thin piece of glass.

“Poor people have to have something. Everything is for the rich people, and the poor people are just hurting. They’re on their own.

“You know all of this falls back on the president,” Henrietta said. “Why has he not frozen these prices? Because he’s rich, and it doesn’t bother him. He represents the interests of the rich people. And the poor, he could care less about. It just all boils back to him. And now, all this oil is coming up in our water in the Gulf—and they don’t want to stop the oil because they’re going to make money off of that. What’s that doing to our fish and all the wildlife that’s there? They talk on the news about finding four or five turtles a day—and lord only knows how many are really dying. They won’t even say. Why don’t they stop that and protect those little creatures? It’s awful.

“But the very same things are allowed to go on there, and here in the mines, because of money,” she said, noting that the mine operators regularly cut corners on safety. In the early 1980s, she told the WSWS, “When my husband worked in the mines, he had an air quality monitor he wore that was supposed to detect unsafe levels of coal dust, how much of it they breathed a day. Well, he was to cut that off, just supposed to use it so many hours a day.

“He would have gotten fired if he left it on. So he was breathing all that dust, but that machine only showed that he was getting two hours a day. And you know, that’s not right. I think a human’s life is triply worth any amount of money you can get.” Today he suffers from black lung, Henrietta told the WSWS.

“If things get much worse, I don’t think the lord’s going to let there be many more generations. Things are terrible, and it’s getting worse. We need clean rivers, clean water, we need to clean that oil spill. If the people don’t pull together and do something, nothing’s going to be done about it.”

The American Legion Takes A Stand Against Illegal Immigration

The America Legion recently released a statement on ILLEGAL IMMIGRATION, a very pointed statement. The Legion published their policy in a 30 page booklet, spelling their policy out in detail:
The nation’s largest veterans organization released this week a policy bulletin that takes a firm stand against illegal immigration and calls on its members to hold elected officials accountable for implementing and enforcing U.S. immigration law.

The 30-page bulletin is officially titled, “The American Legion20Policy on Immigration: A Strategy to Address Illegal Immigration in the United States.”
It is about time that a group who stands up for veterans of all services, whether they served in peacetime or wartime took a tough stand on a problem that is overwhelming this country. We have roughly 25 million veterans in this country who served honorably to protect the legal residents of this country, not the people who invade our borders nearly unchecked.

“The American Legion members have served in the U.S. Armed Forces throughout the world so that Americans can be safe at home,” the organization’s website explains. “This gives them a unique perspective to the threat that open borders present to their homeland.”
“America is a nation built by immigrants and the American Legion recognizes and celebrates that,” said National Commander David K. Rehbein in a press release. “We do take strong issue, however, with illegal immigration. It’s a matter of national security. The 9/11 hijackers and three of the men who plotted to kill innocent Americans at Ft. Dix were perfect examples of terrorists exploiting our weak immigration laws and our lack of enforcement. This booklet is a good reminder that America has a serious problem that needs to be addressed.”
The Legion’s stance on illegal immigration is clearly stated o n page 1 of the booklet, it stands alone:
“The American Legion is opposed to any person or persons being in this country illegally, regardless of race, sex, creed, color or national origin,” the bulletin states. “We believe the current laws governing immigration should be enforced impartially and equally.”
The America Legion has a long history that dates back to Theodore Roosevelt. The Legion knows something about supporting veterans and the laws of this country. Read on:
Originally founded in 1919 on an idea proposed by Theodore Roosevelt, Jr. (the president of the same name’s eldest son), the Legion has now grown to a membership of more than 2.6 million wartime veterans organized in more than 14,000 posts nationwide.
The policy bulletin explains, “Legionnaires subscribe to a creed, ‘To uphold and defend the Constitution of the United States of America; to maintain law and order and to foster and perpetuate a 100 percent Americanism.’ These words are recited in unison at Legion meetings and represent a continuing contract of service to benefit America and it is this commitment by Legionnaires that is the fuel for action on illegal immigration and other national security concerns facing this country.”
The Legion hopes the policy booklet will educate the American public on how “the security, economy and social fabric of the United States of America is=2 0seriously threatened by individuals who are illegally in this country.”
“Illegal immigration is not a victimless crime,” the booklet states. “The poor, minorities, children and individuals with little education are particularly vulnerable. It causes an enormous drain on public services, depresses wages of American workers, and contributes to population growth that, in turn, contributes to school overcrowding and housing shortages. Directly and indirectly, U.S. taxpayers are paying for illegal immigration.”
In financial terms, the booklet cites a report by the Center for Immigration Studies that claims the average illegal alien household in 2003 paid approximately $4,200 in federal taxes while, on average, created $7,000 in costs at the federal level.
The booklet does highlight a real problem that the USA faces despite the formation of the Department of Homeland Security. It spells out that it is about educating all people on the dearth of security issues still face this country today. Not only did they publish this booklet for education purposes but it also contains language that discusses ways to prevent these security issues:
In response to what it sees as a contributing factor to crime, terrorism, unemployment and depressed wages, the Legion proposes the following five-point strategy urging the federal government to enact the following steps:
1. Secure the borders and other points of entry in the United States, including construction of a physical barrier and sufficient Border Patrol presence.
2. Eliminate the jobs magnet and social services benefits that draw illegal immigrants to the U.S. by enforcing laws sanctioning employers who hire illegal aliens, implementing employment eligibility verification and eliminating government benefits for illegal aliens.
3. Eliminate amnesty laws that permit illegal aliens to break the law and remain in the U.S.
4. Reduce the U.S. illegal alien population by attrition through workplace enforcement, interagency and interstate cooperation, rejection of driver’s license plans, mandating English as national language and establishing parameters for noncriminal deportations.
5. Screen and track foreign visitors legally entering the United States. The plan further calls for reforms to current legal immigration policy, including alteration of the non-immigrant visa program that allows some nations’ citizens entrance to the U.S. without a visa application, elimination of the visa lottery that randomly approves visas from countries with low immigration rates and expanding visa allowances for seasonal and temporary workers.
The five step program is a good program. It is workable with some change in legislation and enforcement of current laws. It becomes more important when one considers the following report from WND:
Costs for securing the nati on’s borders are expected to increase 20.6 percent in fiscal year 2009. These include expenses for border patrol, electronic surveillance, the border fence and other security needs. President Bush allocated $44.3 billion for the Department of Homeland Security – a 4.5 percent increase from last year’s budget of $42.4 billion.
“While the U.S. builds a fence across much of the border, many illegals are taking a different route. Underground,” Rubenstein reveals. “Authorities have discovered dozens of illegal tunnels across the international border in recent years. Smuggling of drugs, weapons, and immigrants takes place daily through these underground passageways.”
Illegal aliens also use drainage systems to travel across the U.S.-Mexico border – from El Paso to San Diego.
“One tunnel, actually a system of two half-mile passages connecting Tijuana with San Diego, is by comparison a superhighway,” he wrote.
While the Border Patrol attempts to stop these underground incursions with steel doors, cameras and sensors, harsh weather conditions and human smugglers destroy the equipment and barriers.
These costs, and the expenses of providing “enhanced driver’s licenses” as alternative passports for citizens, RFID chips, government databases and watch lists are expected to soar.
In his research, Rubenstein finds that the average immigrant household generates a fiscal debt of $3,408 after feder al benefits and taxes are considered. At the state and local level, the fiscal debt amounts to $4.398 per immigrant household.
“There are currently about 36 million immigrants living in about 9 million households, so the aggregate deficit attributable to immigrants comes to $70.3 billion,” he writes. “… Immigrants could deplete the amount of funds available for infrastructure by as much as $70 billion per year.”
Rubenstein cites figures from the U.S. Census Bureau, projecting that the U.S. population will reach 433 million by 2050 – increasing 44 percent, or 135 million, from today’s numbers.
A full 82 percent of this increase will be directly attributable to new immigrants and their U.S.-born children.
“The brutal reality is that no conceivable infrastructure program can keep pace with that kind of population growth,” he wrote. “The traditional ’supply-side’ response to America’s infrastructure shortage – build, build, build – is dead, dead, dead. Demand reduction is the only viable way to close the gap between the supply and demand of public infrastructure.”
He concludes, “Immigration reduction must play a role.”
The five step program that the Legion proposes is a sound one. It will require the federal government to tighten immigration policies. The policies don’t appear to require bigger government. It does require ou r Democratic-led government to take a tough stand on illegal immigration, one I believe they will never take. Since our government at this point in time will never toughen the laws, this booklet will go largely ignored by our representatives in DC and that is the shame.
The American Legion wants to remind of us the facts surrounding 9/11 and the plot to kill Fort Dix soldiers, nothing more, nothing less. It is time for Congress to listen to the more than 2 million veterans who claim membership in this organization. It is time to secure our borders, it is time that the American people realize our security is at risk as long as our borders are not secure

BENSON, ARIZ. -- Paul Moncada, the silver-haired police chief of this highway town, spent a recent morning anxiously checking the TV for news about Arizona's controversial new immigration law, set to take effect in a matter of days.

He sifted through stacks of state training materials, which still left him with lots of questions. And he worried about the frustrated people in town who might sue him for not enforcing the new law well enough, the frustrated people in town who might accuse him of racial profiling and the thousands who cross the blazing desert around here and whose lives he is also duty-bound to protect.

"There's pressure from all sides, and I understand all the sides," said Moncada, 56, who grew up here and has served on the force 34 years. "I'm just telling my officers: Do your job. It's nerve-racking."

A federal judge has scheduled a hearing Thursday on an Obama administration lawsuit, one of three challenging the Arizona law, which requires officers to check the immigration status of people they arrest or cite for any violation if they have "reasonable suspicion" the person is in the United States illegally. The law has renewed the contentious national debate over immigration reform, sparked huge protests in Tucson and Phoenix and spawned the possibility of similar laws in other states.

Its effects have been somewhat quieter, if no less divisive, in Benson, a town of about 5,000 people, a third of Hispanic descent, about an hour's drive from the Mexican border. It is a tourist stopover and mostly working-class community of flat-roofed adobe homes, pebbly RV parks and more upscale enclaves such as San Pedro Ranches on the edges of town. And as elsewhere, the debate here has mingled with an already trying situation. The troubled economy forced the state to clip Benson's budget, and unemployment, foreclosures and minor crime linked mostly to drug addicts has cast some gloom upon the city motto, "Hang out in Benson!"

Some residents have come to associate a general sense of decline with illegal immigration, which is visible here in the desert litter of backpacks and water jugs, and in the crammed-full vans that drivers sometimes ditch along the highways, sending passengers fleeing. In that context, the new law has inspired feelings from profound unease to a kind of righteous victory, which often sort along ethnic lines.

A sense of fear

"Amen" is what Danna Judd said when Republican Gov. Jan Brewer signed the law in April.

She and her husband, Bevin, a UPS salesman, moved from Tucson to a new house on 22 acres in San Pedro Ranches three years ago, but their rural-lifestyle fantasy was quickly spoiled. They found stashes of clothes when they were out for desert walks. They found a smuggler's van abandoned in their gravel driveway. More recently, they arrived home with their two kids from an evening baseball game to a scene of floodlights and U.S. Border Patrol agents scrambling across their property.

"My neighbor called and said they were chasing around 20 people," Bevin Judd said. They ushered the kids to bed, turned on all the lights and locked the doors.

Like many who grew up in Benson, Bevin Judd remembers giving bread and water to Mexican farmworkers who crossed through town when he was a kid. He remembers leaving doors unlocked, keys in the car. "But now it almost seems like there's a criminal element to it," he said. The sense that crime has increased with illegal immigration isn't supported by either local or statewide crime statistics, although that is difficult for some around here to believe.

"It makes you afraid," said Danna Judd, a deputy city clerk. "You don't know who is out there. Are they drug smugglers? Do they have guns?"

To the Judds' relief, the one person who definitely does have guns is their neighbor Bob Dekoschak, 62, who was cleaning out his horse barn in the late afternoon. The wind blew the chimes. His wife, Elise, arrived home from work, and they sat under ceiling fans in their library packed with James Michener novels and books on Latin American culture.

"When we were moving here, we talked to a friend who said, 'Oh, and how armed are you?' " explained Elise Dekoschak, 60, who works for the state government.

Bob Dekoschak, who works for an international software manufacturer, already had a 12-gauge shotgun, but he bought two more, along with a .357 magnum.

As the sun sank into the crumbled landscape, the Dekoschaks talked of feeling isolated from law enforcement, which is spread so thin. They talked about the things they blame, at least partly, on illegal immigration: the state's failing schools, the closed hospitals, strained local budgets. They question its comparative benefits of cheap lettuce and cheap houses that helped drive Arizona's boom years.

"When Brewer brought this forth, she did it for those of us on the front lines," Bob Dekoschak said. "Those of us armed. Those of us with illegals running through our yards. We can't keep placating the Hispanic community. What we need is a division of Marines . . . "

He paused. Elise held up her hand. "Wait," she said. "What's that?"

A chopping noise; a helicopter, they decided. Maybe Border Patrol.

No practical effect?

In the police station, Moncada was listening to radio calls. An officer was investigating a burglary suspect; another was checking out a crystal-methamphetamine lab; a highway patrol officer had stopped two men in a car and needed a Spanish speaker.

"I guess that's me," said Moncada, one of two Hispanic Americans on the force of 16 officers. He walked out into the 105-degree noon and sped off in his gray Chevy.

"I don't know what it is," he said, gliding onto Interstate 10. "But if you work in the southern part of Arizona, you should speak Spanish."

At the scene, the patrol officer explained that he'd pulled over the burgundy Dodge Falcon for speeding and following another car too closely. The driver had produced a Mexican license and a proper visa. The passenger produced his legal resident card. But the car was not registered to them. And after Moncada asked a few questions, the two men's stories did not match.

Moncada watched the two men as the patrol officer searched the trunk, the door frames, the engine, shining his flashlight into its crevices. Nothing. They let the men go.

"I think he was running heat," the chief said of the driver, referring to a common smuggling tactic around here, in which one car distracts the police so others get through. He got back into his Chevy.

"With the new law," he said, rehearsing a future scenario, "nothing would have changed on that stop."

And for Moncada, at least, that is the irony of the new law: Although heightening fears and expectations, threatening lawsuits and creating confusion, it is unlikely to change much about how his officers do their jobs, he said.

Already, if they stop a speeding van and people bail out running, officers generally make the leap and call Border Patrol. The new law essentially requires that call, along with one to verify the immigration status of every local drug addict, drunk driver or shoplifter arrested after next Thursday, when the law takes effect, barring an injunction. Although the law might play out differently in other places, Moncada said, his police will not use it as an excuse to hunt illegal immigrants. As a practical matter, he and other chiefs said, they are simply too busy with regular crime.

"I really don't know if it will have any significant effect at all," the chief said. "Will it fill the jails? Probably not. Will it be a deterrent? Probably not."

He drove down Route 80, past a blur of beige desert, past the iron gate where some ranchers found a body a few weeks ago.

"The poor guy was just laid out there," Moncada said, pointing to the spot. "We didn't find any water jugs. No backpack. It was miserably hot that day, 109 degrees. You can only imagine what kind of death . . . "

'What's next?'

When the new law was introduced, Melissa Herrera-DiPeso, who runs a real estate agency in town, interpreted it as a license for the police to racially profile Hispanic Americans. This was based upon her memories of growing up in Tucson, when some white parents didn't let their daughters play with her. In high school, she had a white friend who was not allowed to have a Mexican boyfriend. Now a successful, glamorous-looking woman with a son attending Stanford University, she has been forced to wonder again how others see her.

"My white friends say, 'Oh, Melissa, you're making such a big deal of it,' " she said, sitting in her office. "But they're white. They don't have to deal with it."

She, too, is afraid of drug-related violence spilling over from Mexico. And like everyone, she is hopeful that the controversy will push the federal government to deal with immigration reform, although realistically, she figures it won't. And so she worries, about news that a list of illegal immigrants was circulating in Utah, about a mood of vigilantism that she believes Arizona's new law has encouraged.

"There's so much anger and frustration," she said. "If this law doesn't work, what's next?"

Wary of the effects

Down a gravel driveway, behind a locked gate, a man who preferred that only his first name, Marco, be used, considered that question.

He arrived in Tucson seven years ago on a tourist visa, found work framing the new houses. He got a paycheck then and paid taxes. He brought his wife and two kids to join him, and they moved to Benson, where he works for a rancher.

"We're not just here to benefit," said Marco, 37. "We're also giving."

He rents a trailer where he sat down on an overstuffed couch in a room decorated with frilly maroon curtains, his son's baseball trophies, family photos, two paintings of Jesus and one of the Virgin of Guadalupe.

He is nervous about the new law, he said, and like everyone else, he is preparing.

He has gathered all the documents he can find in a desperate hope that they might satisfy police asking for papers: some invoices from a store he owns in Mexico; a letter of recommendation from his home town's mayor. He plans to fix the small crack in the windshield of the sedan he drives to work, an infraction that could lead to his deportation if the law takes effect. He will try to look friendly but unassuming.

"I always try to dress clean, not dirty, like I've been walking through the desert," Marco said. Still, he worries about what might happen.

"Maybe it was a mistake to bring my family here," he said. "If it gets too tough, I will go. Maybe California."

In Pinal County, Arizona, 90 miles NORTH of the Mexican Border you will find Interstate 8. I-8 runs from San Diego, Ca. to Casa Grande, Az. Just East of the A.F gunnery range ( East of Yuma ) pull you car off of the Freeway and you will see large signs placed there by the Feds. Basically the signs tell American Citizens not to enter , this land has been unofficially ceded to Mexico !


The Pinal County Sheriff won't send his men in there , they would be outnumbered and OUTGUNNED. Can the people of other States understand the anger and frustration of Arizonans ? Local residents, who three years ago didn't feel the need to carry handguns, now openly do so. The anger comes from the knowledge that our Mexican Border is left in limbo because this Administration wants to make a POLITICAL STATEMENT. Change we DO believe in and not for the better.
